			<content:encoded><![CDATA[<p>My daughter sold her house under the &#8216;short sale&#8217; guidelines. She had a second mortgage on the house. She was led to believe that when she was approved for the short sale that it included an approval by the second mortgage lender. Now she is being told that she owes a huge chunk of money. She was never given this information by her real estate agent. Shouldn&#8217;t the second mortgage lender have approved of the short sale before the final closing? Does she have any recourse?<br />
<br />Your daughter is the first of many whom I&#8217;ll afraid are going to deal with this.</p>
<p>The short sales was agreed to by the first and the 2nd mortgage holders, but the fine print is VERY important.  The banks agreement does NOT mean that they are willing to forgive the additional debt owed, it just means that they are willing to allow your daughter to sell the asset vs foreclosing on it.</p>
<p>The fine print states if the bank still holds the borrower liable for any shortfall.  If it states that the bank released her from liability, then call the collection agency and fax them a copy.</p>
<p>I&#8217;d recommend you have the paperwork reviewed by a real estate or bankruptcy lawyer.  They can tell you very quickly if the bank did everything right, or if there is a loophole.  If they did to it right, and didn&#8217;t release deficiency, she&#8217;ll have to deal with paying something.  It that case hiring a lawyer to negotiate the smallest payment would be recommended. (AKA she can negotiate paying less then the full amount).</p>

<br />#1 &#8211; Bad credit is not due to divorce.  It is due to not living up to the financial obligations that you signed up for.</p>
<p>#2 &#8211; You do not NEED to purchase a home.  You WANT to purchase a home.  This unrealistic sense of need vs. want is probably what led to #1.</p>
<p>#3 &#8211; If you want to eventually purchase a home, go rent something cheap, and clean up the derogatory marks on your credit report.  (i.e. PAY your debts.)  Then, save up a reasonable down payment (20% minimum) and shop for a reasonable home.  A reasonable home is one with a 15 year fixed rate mortgage with a payment of no more than 25% of your take home pay.</p>

<br />Anyone can make payments on anybody&#8217;s loan that they choose to. I&#8217;ve made many an installment payment for my children at various times. All the bank or finance company cares about is that you put the correct account number on the check so they know where to credit the payment.

			<content:encoded><![CDATA[<p>As the questions says&#8230; I just bought a house and want to get a mortgage to pay back my parents who loaned me the cash to top up my purchase. I am confiused, however, do I require a regular mortgage or a remortgage?<br />
<br />For what you&#8217;re talking about, you would want a regular mortgage, since you don&#8217;t have a mortgage yet, but I would just go with a home equity loan.  There is also something called a reverse mortgage.  I&#8217;m not sure how it works, but it&#8217;s supposed to be better than the standard mortgage.<br />
